H.G. Technology & Services Private Limited (formerly known as H.G. Integrated & Services Private Limited) is a company incorporated in India under the Companies Act, 2013, having its registered office at 4th Floor Pavilion, SB-56, Tonk Road, Opp. Sawai Mansingh Stadium, Bapu Nagar, Jaipur, Rajasthan, India, 302015.

H.G. Technology & Services Private Limited is the licensee and operator of the Platform (“Equipmint”). The Platform provides a range of online resources, including: (a) listings and related support services offered through select entities on the website https://equipmint.in (and on any corresponding mobile application that may be made available by Equipmint in the future); and (b) an online service facilitating the leasing, renting, buying, and selling of machinery by connecting owners and users through select partners on the website https://equipmint.in (and on any corresponding mobile application that may be made available by Equipmint in the future). All such websites and mobile applications are collectively referred to as the “Platform.” As of the effective date of these Terms, Equipmint is accessible only through its website; references to any “mobile application” or “App” apply prospectively to any such application that Equipmint may launch in the future.

These Terms of Use (“Terms”) govern your access to and use of the Equipmint platform and related services (collectively, the “Platform” or “Services”). By accessing or using the Platform in any manner, you agree to be bound by these Terms. For the purposes of these Terms, “User”, “you”, or “your” means any individual or entity that accesses or uses the Platform, whether through manual or automated means. This includes, without limitation, users who browse the Platform, list products or services, request price estimates, or create listings.

When using specific features or portions of the Services, you agree to comply with any applicable policies, guidelines, or rules posted on the Platform, which may be updated from time to time at Equipmint’s discretion. Equipmint reserves the right to modify or update these Terms at any time at its sole discretion. You understand and agree that you are solely responsible for reviewing these Terms from time to time. Your continued use of the Platform after such changes become effective constitutes your acceptance of the revised Terms. If you do not agree with these Terms, any applicable guidelines, or any updates thereto, you must discontinue your use of the Platform immediately.

These Terms may be translated into languages other than English for convenience. In the event of any conflict or inconsistency between the English version and any translated version, the English version shall prevail and govern your relationship with Equipmint.

Equipmint operates an online platform that enables users to offer, sell, buy, or rent machinery, construction equipment, and related products or services (“Listed Items”). Equipmint acts solely as an intermediary and is not a party to any transaction between users. If the Platform does not facilitate payments or related services through any third-party providers, Equipmint is not involved in such transactions and does not control any aspect of them.

Accordingly, you acknowledge and agree that Equipmint is not a party to any transaction between users, has no control over the quality, safety, legality, or delivery of Listed Items, and shall not be liable to any party in connection with such transactions. All use of the Platform and Services is at your own risk.

Equipmint provides a marketplace that enables users (“Listers”) to list Items. Equipmint does not own, manage, or verify listings and is not a broker, agent, dealer, or representative of any user. Further, Equipmint is not a party to any interaction, negotiation, or agreement between users. You acknowledge that Equipmint has no control over listings, including the accuracy or completeness of any information provided therein. However, Equipmint reserves the right, but not the obligation, to monitor, review, verify, moderate, or remove any content or listing at its sole discretion for purposes including fraud prevention, regulatory compliance, and maintaining platform integrity.

The Platform contains user-generated content including listings, images, videos, and other materials (“Content”). You acknowledge and agree that Equipmint does not control or pre-screen such Content, and that such Content may be inaccurate, misleading, offensive, or otherwise objectionable. You further acknowledge that you access and rely on such Content entirely at your own risk.

The Platform may contain links to external third-party websites (“Third-Party Websites”). Equipmint does not control or endorse such websites and makes no representations regarding their accuracy or authenticity. Accordingly, Equipmint disclaims all liability in relation to your use of such Third-Party Websites.

If you are a Lister, you are solely responsible for any Content you post, upload, transmit, or otherwise make available on the Platform and for the consequences thereof. You represent and warrant that you own or have all necessary rights, licenses, and permissions to use and share such Content, that such Content does not infringe any intellectual property or other rights, and that you have obtained all necessary consents from identifiable individuals or entities featured in such Content.

By submitting Content on the Platform, you grant Equipmint a worldwide, non-exclusive, royalty-free, sub-licensable, transferable, perpetual, and irrevocable license to use, reproduce, distribute, modify, display, and create derivative works of such Content in connection with the Platform and Equipmint’s business. You retain ownership of your Content; however, you grant Equipmint the rights necessary to operate, promote, and improve the Platform.

Equipmint may provide tools that automatically generate descriptions or other content based on user inputs, such as images or data. Equipmint does not guarantee the accuracy or completeness of such generated content, and you are responsible for reviewing and editing such content prior to publication.

Equipmint does not endorse any Content or user opinions. Equipmint prohibits intellectual property infringement and reserves the right to remove or restrict any Content that violates these Terms or applicable law. Equipmint may suspend or terminate users who repeatedly violate these Terms.

The lister agrees not to submit any descriptions, photographs, financial, contact, or other information related to any listed item on the Equipmint platform unless they have obtained all necessary rights and authorizations from the rightful owner or authorized representative. This includes permission from photographers or copyright holders for any images used.

The Equipmint platform is intended only for users who are 18 years of age or older. Listers must ensure that their content does not target or exploit children in any way.

Listers are required to comply with all applicable laws and regulations while using the platform. They must provide accurate, clear, and transparent information about their products, including business details, contact information, pricing, and policies related to returns, refunds, warranties, and payments.

Equipmint reserves the right to monitor and remove any listings that violate these guidelines at its sole discretion. It may also request proof of compliance from listers and take necessary action, including suspending or terminating accounts that repeatedly breach the terms.

At Equipmint, transparency and reliability are at the core of our platform. We strongly encourage all users and potential buyers or renters to conduct proper due diligence before engaging in any transaction involving movable property such as construction machinery.

Users and potential buyers or renters are advised to independently verify the authenticity, condition, and suitability of any listed machinery at their own cost and discretion. It is important to verify the ownership and credentials of the seller or owner by reviewing relevant documents such as purchase invoices, ownership records, rental authorization (where applicable), and valid identification proofs.

Users must exercise caution while reviewing documentation and remain alert to the possibility of forged or misleading records. All documents should be verified in accordance with applicable laws.

For construction machinery, buyers or renters should ensure that the seller or owner has complied with applicable industrial and safety regulations. It is essential to carefully review all relevant documentation such as registration certificates, insurance papers, maintenance and service records, and any required safety or pollution certifications.

Equipmint remains a neutral intermediary and is not a party to any transaction. We do not guarantee the accuracy of listings or the authenticity of sellers, owners, or lessors. Users are solely responsible for verifying all information and are advised to seek independent legal or financial advice before making any commitments, payments, or rental agreements.

You undertake that all descriptions, images, and other content relating to your goods or services listed on Equipmint are accurate and correspond directly with the actual appearance, nature, quality, purpose, and other material features of such goods or services.

You agree not to post, upload, publish, transmit, store, update, or share any information or content on the platform that violates any applicable law, rule, regulation, or guideline, including but not limited to the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection Act, 2019.

You agree not to upload or share any content that is unlawful, harmful, abusive, defamatory, obscene, invasive of privacy, misleading, fraudulent, or otherwise objectionable, including content that promotes discrimination, hate, harassment, money laundering, or illegal activities, or that may harm minors in any way.

You further agree not to misuse the platform by manipulating prices unfairly, discriminating between users, engaging in harassment, unsolicited contact, or data collection without consent. The use of automated tools such as bots, crawlers, or scraping technologies to access, copy, or manipulate platform data is strictly prohibited, except where explicitly permitted.

Any content uploaded by you shall be subject to applicable laws and may be reviewed, removed, or disabled if found to be non-compliant. Equipmint reserves the right to take appropriate action, including suspension or termination of your account, in case of violation of these terms, applicable laws, or platform policies.

Equipmint shall charge a one-time registration fee of INR 100 (Rupees One Hundred only) at the time of user registration on the platform. Upon successful payment and completion of the registration process, users will be able to log in using their registered email ID and a One-Time Password (OTP) verification mechanism.

All payments made towards registration are final and non-refundable. By proceeding with the payment, the user expressly agrees that no refund, cancellation, or reversal of the registration fee shall be permitted under any circumstances, including but not limited to non-usage of the platform or dissatisfaction with services.

As used herein, the term “Posting Agent” refers to a third-party agent, service, or intermediary that posts Content to the Service on behalf of others. Equipmint prohibits the use of Posting Agents, except with express written permission or license from the original owner of the listed Items. Failing such permission, the Lister (Posting Agent) shall solely be liable for any breach, infringement, claims, penalties, or damages claimed by the original owner or right holder of such Listed Item.

Equipmint hereby grants you a limited, revocable, non-exclusive, and non-transferable license to access and use its platform and services strictly for personal, lawful, and non-commercial purposes, in accordance with these Terms and Conditions.

Except as expressly permitted under these Terms, you shall not engage in any unauthorized access to or use of the platform. Prohibited activities include, but are not limited to, the collection, aggregation, copying, duplication, reproduction, display, republication, or creation of derivative works from any content available on the platform.

General-purpose internet search engines and non-commercial public archives are permitted to access and index the platform solely for the purpose of displaying hyperlinks to Equipmint, provided such activities are conducted using stable and identifiable IP addresses, clearly identifiable user agents, and in full compliance with Equipmint’s applicable technical protocols, including its robots.txt file.

You may create a hyperlink to the homepage of the platform, provided that such link does not portray Equipmint in a false, misleading, derogatory, defamatory, or otherwise objectionable manner.

Any use of the platform or its content beyond the scope expressly permitted under these Terms shall result in the immediate termination of the license granted herein, without notice. Equipmint reserves all rights not expressly granted under these Terms.

Equipmint is not liable for any intellectual property infringement arising from content posted or shared on the platform by users or third parties.

If you are the owner of intellectual property rights, or authorized to act on behalf of one, and believe that any content on the platform infringes such rights, you may notify Equipmint with relevant details and request removal of the content via the designated email.

Upon receiving a valid request, Equipmint may take appropriate action in accordance with applicable laws.

You acknowledge and agree that all materials available on the Equipmint platform, including but not limited to text, software, graphics, images, videos, audio, and other content (“Materials”), as well as trademarks, service marks, and logos (“Marks”), are owned by or licensed to Equipmint and are protected under applicable intellectual property laws in India.

All Materials are provided on an “as is” basis for personal and informational use only. You shall not copy, reproduce, distribute, modify, transmit, display, sell, license, or otherwise exploit any Materials or Marks for commercial or non-permitted purposes without prior written consent from the respective owner.

You agree not to reverse engineer, decompile, disassemble, or attempt to extract source code from the platform, nor to bypass or interfere with any security features. Any unauthorized use of the platform or its content, including reproduction or redistribution on other platforms or servers, is strictly prohibited.

Equipmint reserves all rights not expressly granted under these Terms.

You understand that when using the Platform, you will be exposed to Content from a variety of sources and that Equipmint is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such Content, and you agree and assume all liability for your use.

You further understand and acknowledge that you may be exposed to Content that is inaccurate, offensive, indecent, objectionable, defamatory, or libelous and you agree to waive any legal or equitable rights or remedies you have or may have against Equipmint with respect thereto.

You agree to defend, indemnify, and hold harmless Equipmint, its affiliates, directors, officers, employees, agents, service providers, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your access to or use of the platform or services, your violation of these Terms, your infringement of any third-party rights, any content submitted or shared by you, your failure to obtain necessary consents or approvals, your non-compliance with applicable laws, and your failure to review or adhere to the terms of third-party service providers or partners whose services you access through the platform.

This obligation to defend and indemnify shall survive the termination, modification, or expiration of these Terms and your use of the platform.

You acknowledge and agree that Equipmint shall not be responsible or liable for any interactions, communications, or transactions between you and any other users, individuals, or organizations on or through the platform. This includes, without limitation, dealings related to payment, delivery of goods or services, and any representations, warranties, or terms agreed upon between such parties.

All such interactions are solely between the concerned users or third parties. Equipmint does not participate in, control, or guarantee any aspect of these dealings and shall not be liable for any loss, damage, or dispute arising from them.

In the event of any dispute between users or between users and third parties, you acknowledge that Equipmint has no obligation to intervene or mediate such disputes. To the fullest extent permitted by law, you hereby release and discharge Equipmint, its affiliates, officers, employees, agents, and successors from any and all claims, demands, liabilities, or damages of any kind, whether known or unknown, arising out of or related to such disputes or the use of the platform.

By using our Services and the website, you confirm that you understand and agree that the website and all content on the website are provided to you on an “AS IS” and “AS AVAILABLE” basis without warranty of any kind, either express or implied. Equipmint makes no warranty as to the accuracy, completeness, or reliability of any content available through the website. You are responsible for verifying any content or information before relying on it.

Equipmint makes no representations or warranties that use of the website will be uninterrupted, error-free, or virus-free. You are responsible for taking all necessary precautions to ensure that any content you may obtain from the website is free of viruses or other harmful code.

To the maximum extent permitted by applicable law, Equipmint disclaims all liability, whether based in contract, tort, strict liability, or otherwise, and further disclaims all losses, including without limitation indirect, incidental, consequential, or special losses and damages arising out of or in any way connected with access to or use of the website, the content, or the services by you.

This section shall survive the termination of this Agreement and the termination of your use of our Services or the Website.

Your use of the Equipmint platform and services is entirely at your own risk. The platform is provided on an “as is” and “as available” basis without any warranties or guarantees of any kind, including any guarantee of sale, purchase, accuracy, or completeness of listings.

To the fullest extent permitted by law, Equipmint disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Equipmint does not guarantee the accuracy, reliability, or completeness of any content, listings, or third-party information on the platform.

Equipmint shall not be liable for any loss, damage, fraud, misrepresentation, or disputes arising from user interactions or transactions. All dealings are solely between users, and users are responsible for independently verifying all listings and counterparties before engaging in any transaction.

Equipmint acts only as an intermediary platform and does not control, endorse, or participate in user transactions. Any disputes or grievances must be resolved directly between users, and Equipmint bears no responsibility for such matters.

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you but may be assigned by Equipmint without restriction. Any assignment or transfer by you shall be null and void.

You affirm that you are at least 18 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms.

This Platform is intended only for adults and you represent that you are eligible to contract as per applicable laws. If you are using or accessing this Platform as a representative of any person or entity, you acknowledge that you are legally authorized to represent that person or entity.

Minors, that is users under 18 years of age, are only allowed to access the Platform with prior approval of their legal guardian. Minors are not allowed to use the Service. Minors under Indian law cannot enter into contracts with third parties and hence cannot transact using the Platform.

Notice to minors: If you are a minor, please do not send us your personal information, including your email address, name, or contact information. If you want to contact us, you may only do so through your parent or legal guardian.

This Agreement shall be governed by the laws applicable in India. Any dispute relating to the use of our Services or breach of this agreement will be resolved exclusively in the courts at Jaipur, Rajasthan.

All payments made towards registration or platform access are non-refundable.

However, in cases of failed transactions, duplicate payments, or technical errors, eligible refunds will be processed within 5–7 working days.
